Exxon wins less than expected from Venezuela dispute (Reuters)

CARACAS (Reuters) ? An arbitration panel has awarded U.S. oil giant Exxon Mobil Corp $908 million in compensation for Venezuela's 2007 nationalization of its assets, less than 10 percent of what the company sought in a long legal battle with the OPEC nation.

Venezuelan President Hugo Chavez likely will celebrate the ruling as a vindication of his nationalist confrontation with oil companies aimed at increasing revenue from the industry to boost funding for state-led anti-poverty programs.

But Venezuela faces another arbitration with Exxon (XOM.N) over the nationalization of the Cerro Negro heavy oil project, and more than a dozen pending claims from companies like oil major ConocoPhillips (COP.N) resulting from a wave of state takeovers.

"They must be elated that they got off so cheap. It's certainly a happy new year for Venezuela," said Russ Dallen, head bond trader at investment bank Caracas Capital Markets.

"But what gives Exxon hope is that it's only the first of two arbitration proceedings."

An Exxon spokesman said in an e-mail on Sunday that the International Chamber of Commerce, or ICC, had ruled that Venezuela's state oil company, PDVSA, "does have a contractual liability to Exxon Mobil. The ICC award is for $907,588,000."

The decision was made by a tribunal of the Paris-based ICC, which calls itself the world's leading institution for resolving cross-border business disputes and says it has handled several hundred cases a year since 1999.

Exxon had sought as much as $10 billion in compensation for its heavy crude upgrading project in the South American country's vast Orinoco belt, which was nationalized by Chavez along with three others. The award is less than the $1 billion Venezuela offered in compensation in September.

In addition to the ICC claim, Exxon filed for arbitration with the World Bank's International Centre for Settlement of Investment Disputes, or ICSID, over the same issue. The Exxon spokesman said that case was scheduled to be argued next month, and that the date for any verdict was not yet known.

Prices for Venezuela's widely traded bonds are likely to react positively to the news given some expectations that the award could have been higher, Dallen said. Venezuela's sovereign debt and PDVSA's bonds may get a lift on Monday.

A limited payout in the claim will help the socialist Chavez continue to boost state spending on public assistance and housing for the poor in the run-up to his October re-election bid, which is seen as the toughest of his 13 years in power.

STATE TAKEOVERS

The dispute between Exxon and Chavez became symbolic of the conflict between countries seeking more revenue from the booming oil industry and companies insisting on respect for investments and compensation for state takeovers.

The ICC decision appears to award Exxon a sum close to the $750 million it said it invested in the project - the amount Venezuela says Exxon deserves following the takeover.

But Exxon insists it should also be compensated for the increased value of the project, which at its outset in the early 1990s was considered risky because of low oil prices and uncertainty about the relatively untested operations to turn tar-like Orinoco oil into valuable light crude.

"Exxon took a risk when they went in. I'm sure they were expecting more than just making their money back," said Dallen, adding that it will be hard to reach a definitive conclusion about what the decision means until more details are released.

The Exxon spokesman told Reuters the company was still reviewing the more than 400-page ruling.

In 2007, Venezuela bought back $630 million in bonds issued to finance the Cerro Negro project, which Dallen said may have figured into the calculation of the award.

Local analyst Asdrubal Oliveros of Ecoanalitica estimated the value of Exxon assets in Venezuela at around $4.5 billion.

ConocoPhillips was an investor in two of the four Orinoco upgrader projects. Exxon and Conoco, who had in total asked for as much as $40 billion in compensation, both left the country after the nationalizations.

Venezuelan Energy Minister Rafael Ramirez has said the country does not expect to pay more than $2.5 billion for the combined total of the claims by the two companies. PDVSA said in a debt prospectus it had set aside $1.5 billion in provision for litigation as of the first half of 2011.

Venezuela's outstanding arbitration claims include disputes with Swiss cement-maker Holcim (HOLN.VX) and Canadian miner Gold Reserve Inc (GRZ.A), which could force it to make large payouts.

Chavez's steady push to boost control over the country's oil industry started in 2004 and was followed by similar efforts in oil-producing countries ranging from Ecuador to Kazakhstan.

Critics say his nationalization drive has slowed foreign investment that could help lift Venezuela's crude production, which has been stagnant for years, and left fewer companies interested in its oil fields.

Relations between Exxon and Venezuela were particularly acrimonious. In 2008, Exxon won an injunction against PDVSA to freeze up to $12 billion of its assets, a ruling that was quickly overturned but triggered furious criticism from Chavez.

Oil companies have remained eager to invest in the Orinoco belt, which is considered one of the world's largest crude reserves, with U.S. major Chevron (CVX.N) and Spain's Repsol (REP.MC) signing investment deals in 2010 for new multibillion-dollar projects there.

D-Link DHP501-AV Powerline AV 500 Adapter Starter Kit

Powerline networking, which uses your home?s electrical wiring to send and receive data, has been around for years, but until recently it has been held back by slow throughput speeds, interference from other electrical appliances, and the emergence of Wi-Fi as the preferred home networking technology. However, the latest crop of powerline devices now offer ?theoretical? throughput speeds of 500 Mbps and are impervious to interference from all but the most power hungry appliances. And when it comes to transferring large chunks of data, powerline is exponentially faster than Wi-Fi. D-Link?s DHP501-AV Powerline AV 500 Adapter Starter Kit ($159.99 list) has everything you need to add powerline technology to your network. It offers speedy transfer rates and installs in minutes, but the adapters are bulky and can be easily disconnected from their outlet.

Features and Design
Like Netgear?s Powerline AV 500 Adapter Kit?($159, 4 stars)?the D-Link DHP501-AV Kit comes with two adapters, two Ethernet cables, and a CD containing a quick installation guide and a Management utility. ?The disc also includes a user manual, a feature missing from the Netgear kit. Measuring 3.9 x 2.7 x1.8-inches (HWD) the DHP501-AV adapters are taller and wider than the Netgear AV 500 adapters but are identical in weight (0.4 pounds). However, the D-Link adapter?s electrical contacts are mounted on a block that juts out 3/8 of an inch from the back of the housing, preventing the adapter to sit flush with the wall. As a result, the adapter can be easily knocked out of the outlet. In fact, I had to tape one adapter to the wall to keep it from falling out of an older outlet in my house. The adapter?s height also makes it difficult to use the second outlet; I was able to use a two-pronged plug above the adapter but a three-pronged plug, such as those used for most PCs, doesn?t fit.

The DHP501-AV?s housing is done up in a high-gloss white finish and sports rounded edges and a small D-Link logo on the front. There are also three LED indicators on the front that keep you abreast of what?s going on. The Power LED maintains a solid green glow when the adapter is powered up and blinks when it enters power saving mode or when security settings are being changed. The Powerline LED is green when connected to a network and blinks when transmitting data. The light is off if no compatible powerline device are found. A green light indicates a link rate greater than 80 Mbps, while an amber light means the link rate is somewhere between 50-80 Mbps. Red means a rate of less than 50 Mbps. The Ethernet port is positioned on the right side of the adapter, as are a security button and a reset switch that returns the adapter to its factory settings. Setting up the 128-bit AES security is painless; simply press the security button on one adapter until the Power LED blinks (about two seconds). That generates a random encryption key that will be used by all compatible HomePlug AV adapters on the network. Next, press the security button on the second adapter, but make sure you do it within two minutes of pressing the first button, otherwise it will not share the key. For more than two adapters, repeat the process.

Setup and Installation
In order to use the D-Link Powerline Management Utility you first have to install the WinPcap packet capturing software. The utility console lists all powerline devices installed and running on your network and displays the name, MAC address, location (local or remote), connection quality, link rate, and firmware version of each device. From this console you can upgrade the firmware for each device, change encryption key settings, and rename the adapters. However, you can?t assign QoS (Quality of Service) priorities to each adapter like you can with the Netgear Powerline Utility. Instead, the DHP501-AV uses a proprietary QoS technology that looks for data that typically requires high bandwidth, such as gaming and video files, and automatically gives it a high priority. ?

Installation is a snap. Plug one adapter into an outlet close to your router and connect it to the router with one of the Ethernet cables. Avoid using power strips, surge protectors, or extension cords as they may reduce performance. Also, try to use an outlet that isn?t servicing a device that draws a lot of power. Plug the second adapter into any outlet in the house (as long as it shares the same circuit breaker box), and you?ve got wired Ethernet connectivity.

Performance
The DHP501-AV performed quite well on my transfer tests. Copying a 100MB folder from my desktop PC to my laptop (in another room) took 14 seconds, while a 500MB folder took 1 minute and 14 seconds. Both times were slightly faster than the Netgear Powerline AV 500 Adapter Kit, which needed 15 seconds for the 100MB transfer and 1 minute and 20 seconds for the 500MB transfer. In comparison, my Wi-Fi connection needed 1 minute and 18 seconds to transfer the 100MB folder and 9 minutes and 25 seconds to transfer the larger 500MB folder.

The Management utility recorded a 500 Mbps connection from the adapter to the router and 158 Mbps from point to point. The Netgear kit also gave me 500 Mbps to the router but came in at a slightly higher point to point connection rate of 185 Mbps. The DHP501-AV provides more than enough bandwidth for streaming video; The Blues Brothers on Netflix (via my PS3) played smoothly with no stutter and was perfectly in sync. ?

If you want wired Ethernet connectivity throughout your house but want to avoid running cable, the D-Link DHP501-AV Powerline AV 500 Adapter Starter Kit will get the job done. Its bulky adapters may be an issue when it comes to sharing an outlet, however, and it doesn?t allow you to prioritize network traffic. If either issue is a deal breaker, consider the Netgear Powerline AV 500 Adapter Kit instead. ??

Ferguson says he's staying at United 3 more years

(AP) ? Alex Ferguson celebrated his 70th birthday Saturday by pledging to stay as Manchester United's manager for at least another three years.

Ferguson told the famed soccer club's in-house TV channel he still hungers for more trophies even after 25 years in charge of the team.

"I think I've got three years with the club," Ferguson said. "As long as my health stays up, as long as I'm still enjoying it, still giving the satisfaction of the team doing its best."

Ferguson has been reluctant to discuss retirement since announcing a decade ago he would quit after the 2001-02 season. He went back on that promise at midseason and has since led the club to another four league titles ? with last season's triumph giving United a record 19 overall. He has won 27 major trophies with United, including two Champions League titles and five FA Cups.

"You don't win every time. I've had plenty of defeats. But, in the context of the achievements, it's minuscule, the defeats," Ferguson said. "We're all very good at losing here. People say we're great winners, but we're also great losers. You know why? Because we don't let it happen too many times."

Ferguson was greeted by a standing ovation at Old Trafford before United's game against Blackburn on Saturday and serenaded with "Happy Birthday." The Scotsman celebrated his 25th anniversary as manager of United in November and the club marked the occasion by naming a stand at Old Trafford after him.

He's had a few setbacks this season, with United knocked out of the Champions League in the group stage and facing a stiff challenge from crosstown rival Manchester City for the league title. With United in a bit of a rebuilding phase, Ferguson said there is still a lot of work to be done.

"The new players coming into the club ? (Phil) Jones, (Chris) Smalling, Ashley Young ? they didn't win any league medals yet," he said. "We have to continue the dominance of winning leagues and also, without question, winning the European Cup is important to the club. We should have been in at least three other (Champions League) finals. So, yes, I'd be very keen to win a third one."

(AP) ? The Supreme Court set up a judicial commission Friday to investigate a secret memo that threatens the Pakistani government, lawyers said, dealing a blow to the country's leaders, who have argued that such a probe is unnecessary.

The government has suggested its opponents on the Supreme Court, in the military and in the political opposition are using the scandal to try to topple the country's leadership.

The political crisis centers on a memo sent to Washington in May, asking for help in stopping a supposed army coup following the American raid that killed Osama bin Laden.

The memo was allegedly crafted by Pakistan's former ambassador to the U.S., Husain Haqqani, with the support of President Asif Ali Zardari. Both Haqqani and Zardari have denied the allegations, but the envoy resigned in the wake of the scandal.

The army, which has denied it ever intended to carry out a coup, was outraged by the memo and supported the Supreme Court's investigation.

The government argued that a court probe was unnecessary because parliament was the more appropriate forum and was already looking into the matter.

"This is the most disappointing judgment," said Haqqani's lawyer, Asma Jehangir, after the Supreme Court ruling. "National security has been given priority over human rights."

There is long-standing tension between Pakistan's military and its civilian leadership because the army has staged a series of coups and ruled the country for much of its 64-year history.

The Supreme Court decided to set up a three-judge commission to investigate the memo scandal in response to a petition filed by a group of opposition politicians, including former Prime Minister Nawaz Sharif.

The commission will be led by the chief justice of the Baluchistan high court, Qazi Faez Isa, and must deliver its report within four weeks, said Zafar Ullah, Sharif's lawyer.

"We should have trust and confidence in this commission," said Ishaq Dar, a member of Sharif's political party and another one of the petitioners.

Cyril Almeida, a columnist for Dawn newspaper, said the Supreme Court's decision wasn't a surprise, and unless the commission unearthed something dramatically new, the scandal could just fade away.

The worst case scenario for the government would be evidence linking the president to the memo, Almeida told The Associated Press. But even then, Zardari would enjoy immunity from criminal prosecution while in office, and impeaching the president would be difficult given the large number of seats his party has in parliament, he said.

"It doesn't look right now like the commission will be used to undermine the government to the point of where it has to go," said Almeida.

The political crisis comes at a time when Pakistan is facing a violent Taliban insurgency, a stuttering economy and troubled relations with its most important ally, the United States.

A bomb exploded outside a market in a Taliban stronghold in northwestern Pakistan on Friday, killing two people, said Tariq Khan, a local government administrator.

The apparent target of the attack in the Bajur tribal area was a member of an anti-Taliban militia. He was killed, as well as a passer-by, said Khan.
